1. Identity and applicability
Insight is offered by HRM Fitness B.V., registered with the Dutch Chamber of Commerce (KvK) under number 62514725, Heirstraat 28, Urmond, the Netherlands, [email protected]. These terms and conditions apply to all services and agreements of Insight. The terms and conditions are made available to the client before or when the agreement is concluded, so that the client can take note of them.
2. What you buy
The specific service, price, term, content and appointment date are stated on the signed sign-up form or the order confirmation. The scanning device provides estimates and trends of body composition and circumferences; the scan is not a medical diagnosis or treatment.
3. AI training and nutrition guidelines
If included, personal training and nutrition guidelines are drawn up by AI functionality of the scan software, based on the available scan information. They are not medical treatment plans individually established by a doctor or dietitian. Insight does not guarantee results. In the event of illness, pregnancy, medication or complaints, expert medical advice is recommended.
4. Safety check
4.1 Before every body composition measurement by bioelectrical impedance analysis, the client answers the medical safety questions truthfully and reports any changes before a subsequent scan. Insight only asks for information needed to carry out the measurement responsibly and may postpone the measurement if anything is unclear.
4.2 No measurement by bioelectrical impedance analysis is carried out during (possible) pregnancy or if the client has a pacemaker, ICD, neurostimulator or other active implanted electronic medical device. This is a precautionary measure; a scan is not a medical procedure.
4.3 In the case of an artificial hip, artificial knee, metal plate, screws or other metal implants, the measurement by bioelectrical impedance analysis is not carried out until it has been confirmed that this specific situation is permitted under the manufacturer's current instructions. Implants may also affect the measured values.
4.4 In cases including recent surgery, serious problems with fluid balance, feeling unwell, being unable to stand safely unaided, or doubt about a medical circumstance, Insight may postpone or decide against the measurement. A medical certificate does not replace any prohibition by the manufacturer.
4.5 The client receives an explanation in advance of the purpose and limitations of the measurement. The intake form contains the separate health questions and any explicit privacy consent; agreeing to these terms and conditions does not in itself constitute consent to the processing of health data.
4.6 If a measurement does not take place for safety reasons, the parties discuss whether a suitable alternative is possible. If the agreed service cannot be carried out as a result, the parts not delivered are refunded insofar as required by law. Statutory consumer rights continue to apply.
5. Price and advance payment
The confirmed price applies. Payment is made before the single service or before the 4-week period concerned. Late payment does not automatically lead to excessive costs. For consumers, statutory collection costs may only be charged after a correct, free 14-day reminder.
6. Programme and end
If explicitly chosen, the Insight programme has an initial fixed term of 24 weeks at the confirmed price per 4 weeks (at €79: six instalments, €474 in total). The programme ends automatically after these 24 weeks, unless both parties enter into a new agreement before it ends. Statutory rights in the event of a failure to perform or special circumstances remain in place.
7. Cancelling and rescheduling an appointment
Cancel or reschedule an appointment via [email protected]. A request to reschedule is honoured wherever possible. Costs are only charged for missed appointments or appointments cancelled at short notice if a specific, reasonable cancellation policy was communicated separately before booking and validly agreed. In the event of illness or force majeure, the parties will look for a reasonable solution.
8. Sign-up, payment and right of withdrawal
The Insight website provides information about the available services. A request, question or appointment request via the website is not in itself a concluded agreement. The agreement is concluded in person at the Insight front desk at HRM Fitness, after the service and the price have been discussed. Before signing, the client is given the terms and conditions to read and receives them on paper or in another way that allows the client to keep them. Payment takes place before the service is carried out.
For an agreement that is actually concluded at the front desk, there is in principle no statutory 14-day right of withdrawal. After a 3D body scan has been fully and correctly carried out, there is no automatic right to a refund if the client changes their mind afterwards. This does not affect statutory rights in the event of improper performance.
Should Insight nevertheless conclude a distance contract or an off-premises contract in an individual case, the applicable statutory information obligations and, where applicable, the statutory right of withdrawal apply. In that case, Insight provides the required information and the model withdrawal form before the agreement is concluded. Merely making an appointment by phone or WhatsApp does not automatically mean that the agreement has already been concluded at a distance.
9. Performance, complaints and liability
Insight carries out the services with care. Results may vary due to fluid, nutrition, activity and other circumstances. A complaint can be sent to [email protected]; Insight confirms receipt and gives a substantive response within a reasonable period. No provision excludes liability for damage for which exclusion is not permitted by law, or limits statutory consumer rights.
10. Privacy
The separate privacy statement applies to the processing of personal data. Health data require an applicable legal basis under the GDPR and an exception to the prohibition on processing special categories of personal data; where necessary, explicit consent. Data sharing with the supplier of the scanning device or other parties is arranged in accordance with the GDPR.
To carry out and process scans, Insight uses a 3D scanning device and the accompanying software. In doing so, contact details, 3D images, body measurements and health-related measurement results, among other things, may be processed. More information can be found in Insight's separate privacy statement. The public privacy policy of the supplier of the scanning device is not automatically the privacy statement for Insight's services.
11. Changes and applicable law
Changes do not automatically apply to agreements that have already been concluded. Dutch law applies, without prejudice to mandatory consumer protection or the statutory jurisdiction of the courts.
When signing up at the front desk
If you sign up at the front desk, the terms above apply, with the following text for article 8 and for the paragraph on the scanning software in the privacy article.
8. Sign-up, payment and right of withdrawal (front desk)
The agreement is concluded in person at the Insight front desk at HRM Fitness. Before signing, the customer is given the opportunity to read the terms and conditions and receives them on paper or in a way in which they can be kept. Payment takes place before the service is performed.
For an agreement that is actually concluded on location, the statutory 14-day right of withdrawal does not in principle apply. After a 3D body scan has been performed completely and correctly, there is no automatic right to a refund if the customer changes their mind afterwards. This does not affect statutory rights in the event of a failure in the service.
If an agreement is nevertheless concluded at a distance or off-premises, other statutory rules may apply, including a 14-day right of withdrawal. Merely making an appointment by phone or WhatsApp does not automatically mean that the agreement has been concluded at a distance.
Privacy – use of the scanning software (front desk)
A 3D scanning device and associated software may be used to create and process scan results. Contact details, body measurements, 3D images and health-related data, among other things, may be processed. The supplier publishes a public privacy policy; that policy relates to the supplier's websites and does not in itself confirm exactly which data the scanning software processes or in which countries customer data is stored. Insight's separate privacy statement describes the processing for which Insight is responsible. Before use, Insight must establish with the supplier the specific data flows, roles, retention periods and any transfer outside the EEA.
